Robin Brooke to face civil suit over assault

The family of an Australian teen allegedly assaulted by a former All Black when he objected to the rugby player's unwanted attention to a 15-year-old girl is reportedly preparing a civil suit.

Fiji Police Sergeant Suliano Tevita last week confirmed Robin Brooke was being investigated over the alleged sexual harassment of the Auckland girl at the Hilton Denarau on New Year's Eve.

The 15-year-old girl had worked part-time to save her airfare to Fiji to stay with a school friend whose father, Philip Buckleton, owns Beachside Resort at Nadi.

"We took [the girls] to Denarau for New Year because it had security and it was safe," Mr Buckleton said last week.

The girls were sitting next to the pool when Brooke walked past and allegedly grabbed one on the buttocks.

"She yelled out something like `what the hell do you think you're doing, that's disgusting'. A short time later he came back and did exactly the same thing to the same girl, which she couldn't believe."

When the girl's 17-year-old Australian friend, Jordan Whittaker, stepped in, Brooke told him to "settle down or I'll knock you the f**k out".

"He threw me on a deckchair and grabbed my throat ... one of the other girls went and got a guard ... he kept saying 'settle down' and eventually I just said `no'."

The Herald on Sunday today reported Jordan's family doubted charges would be laid and they had started civil proceedings.

Their lawyer, Peter Lowing OBE, sent an email to the 15-year-old's mother saying Sydney lawyer Stuart Littlemore, QC, would be involved.

"On the advice of Mr Littlemore we would initially write to Mr Brooke asking for a written apology and an amount of money as compensation for the assault," Mr Lowing said in the email.

"In all probability Mr Brooke would welcome the opportunity to come to some arrangement without allowing a writ to be served."

Lowing did not expect Fiji police to charge Brooke for reasons including his sporting background, the newspaper reported.

The girl's mother said they were considering joining in the civil proceedings.

"We are not interested in his [Brooke's] money. We won't accept any money," she told the newspaper.

"He actually hurt our daughter. It wasn't just a pinch on the bum -- he physically hurt her and she was doing nothing to provoke that."

Sheila, can you not read? WE are not asking for money. Our daughter has been through a disgusting ordeal and she needs an apology at the very least. But not money - she wouldn't touch Brooke's money, and would prefer to carry on working at her $12 an hour job to save for another holiday next year which will hopefully provide her with better memories than this one did. And be aware that this entire ordeal has been tough on all of her family - her brothers and sisters included. It may seem a petty and insignificant incident to you, but the effects are far reaching, believe me.

It never ceases to amaze me that in previous cases similar to this that the sexual/physical/emotional attack of the victim is so often forgotten. Lets not forget what both of these young people have had to endure. Its about time we stood up as a society and sent a clear message that its not okay to use any kind of violence against each other, and alcohol is no excuse. "Mum" good on you for standing up for the rights of your daughter to be able to socialise in a safe envionment.

Really these families of the victims are greedy for money..c now they sue him for 200000...omg frst you said you need an apology, now you need money..go on brooke fight for it with your lawyer and let this hunger for money people know what they doing

As the mother of the girl in question, I would ask you to read the article again, carefully. I stated that we want NO money. I told the journalist that if there ever was any money, it would be diverted immediately to charity, but that was not printed. I would like him to apologise to our daughter. Money has NEVER been of any interest to us in regard to this and we would refuse it if offered.

"throws the credibility of their claims out"? What the hell? There is never any legal justice for anyone who is the victim of any kind of attack by a sports star. So what do you do? Brooke's behavior is disgusting and I am appalled by the lack of action by the fijian police. It's time the men in our society thought about their daughters, sisters and girlfriends and took a stand against the sexually aggressive/predatory behavior exhibited by (and even encouraged in) so many of our sports stars.

Alien - you obviously live in a dream world. Ask yourself why this guy has not confronted the issue publicly to defend his good name. It has already been reported that he tried to offer money shortly after the event. Starting to sound like a continuation of the M. Jackson saga!

hmmm, so to start with they said that they weren't interested in anything but an apology. Seems like another family wanting money which to me at least throws the credibility of their claims out.
