Bethesda wins lawsuit against Fallout MMO

A settlement has been reached in the ongoing legal dispute between game studios Bethesda and Interplay Entertainment, which gives rights to the Fallout MMORPG to Bethesda – at a cost of US$2 million.

In 2007, Interplay announced it would be creating an online role-playing game based in the Fallout world. Bethesda, the developer of the Fallout titles, subsequently purchased full IP rights to Fallout material for US$5.75 million, but allowed Interplay to continue its project, with a variety of caveats in place.

In April 2009, Bethesda began legal action against Interplay, claiming the conditions of the agreement were not met.

The legal settlement saw Bethesda owner ZeniMax pay a US$2 million settlement to Interplay, in exchange for full rights to the Fallout title.

Bethesda has subsequently cancelled development of the online game.

Bethesda has also launched a lawsuit against Masthead Studios, the company which was developing the Fallout MMO, alleging copyright breaches.
