Nick Smith yesterday appointed Kerry Marshall as Crown Observer

The appointment of a Crown Observer to watch over Christchurch City Council is being described as both illegal and unconstitutional.

A local government watchdog is furious at Minister Nick Smith's decision to give the job to Kerry Marshall.

Jim Candiliotis of Council Watch says they cannot find anywhere in the Local Government Act that allows for such an appointment.

“This is unusual because they’ve borrowed a bit of legalisation from another act and we can’t see where that is constitutional.”

Council Watch has written to both the Ombudsman and Solicitor General.

'Gendy' seems to be one of those interesting 'Reds Under The Beds' illusionists who delight in creating some conspirator theories or other to happily waft away their time in their own little never never land of non-existent 'moneymen' and elves. It's so important to receive these meaningless blogs, if only to relieve the tedium of more contentious comment.

This is in line with the abolishment of Canterbury Regional Council as it was interfering with businesses right to decide on how water is taken from the rivers. The country is being run by the moneymen and it shows, and obviously if you have money you can decide what flavour of democracy is encouraged.

Yes matty. Cantabs are like that. Most seem totally devoid of kind words about who they sarcastically delight in calling 'Jaffas' when it is the Aucklanders who have personally donated by far the largest amounts of cash towards helping them in their plight. I can only take it the Contab inferiority complex is bigger than their ability to accept what has been done for them graciously.

I really don't understand. On one hand Cantabs are complaining about their council being in disarray, then in the next breath they're complaining when the government tries initiatives to patch it up... Damned if you do and damned if you don't.

Nice one Paora. Yes even though Chargone is usually unashamedly anti-National, the comments made (sarcasm aside) can be taken to be in full support of what the Key Govt has done and rightfully so. This is because of the Billions of tax dollars the Key Govt has committed to contribute from the rest of NZ to prop up the Christchurch council efforts for redevelopment. It makes perfect sense to have 'our' representative at council to ensure our tax money is being used wisely.

'Chargone' raises a good point for once. Yes, it was National and good on them. You wouldn't find Labour responding to a need this positively or as quickly for that matter. The only surprise is that 'Chargone' shows a flicker of intelligence enough to recognise this fact.

If there is no 'rule' to say it is OK to make this appointment, where is the 'rule' to say it cannot happen?

Council Watch got it wrong as it up to government to legislate or not so called Ministerial Directive it rare here but not often.
