The Department of Labour will not be taking action against dive company Helix following the drowning of two divers on one of the company’s trips last year.

The DoL conducted an investigation following the incident and found the company was not breaching the Health and Safety Employment Act.

The report will be given to the Coroner for the inquest into the deaths, and cannot comment until the findings have been released.

Daniel Waata, a 33-year-old South Auckland resident was found at a depth of 52 metres, 100 metres from the southern shore.

Mr Waata and fellow student diver and South Auckland resident Tyrone North were on the Adventure Education course run by Helix.

Five students had gone diving with three tutors. Concern was raised when the pair did not return to the surface at the scheduled time.
