Dotcom claims the US has no right as Megaupload is based outside the US. The most money Megaupload made was in the US paid into US accounts, and they had servers in the US as local servers gave better speed/bandwidth that couldn't be done from outside the US. Megaupload was operating in the US, and subject to its laws.Internet providers are like a post office. The law changed and put responsibility on the post offices, like adding sniffer dogs/scanners to reduce contrabnd, ie private customs duties. Other internet companies have spent 100's of millions doing exactly that. Megaupload chose to save MEGABUCKS on this compliance, even promoted that they didn't check content! If have customs officers that should check/stop contraband that help contraband through customs - the officer is crimminally accountable. This is the internet version of the this. This is the basis of the US case against Dotcom and its strong enough Dotcom doesn't want to risk a court case in the US for it.

I wish Kim . com all the best, and I hope he never donates to any NZ politician again, and in fact, I think he should ask for his money to be refunded, he needs some cash at the moment, and they have cost him dearly with their ignorance of the law, and their inept Police force.
