A court has convicted two farmers on an animal cruelty charge for impaling a live cow with a tractor's fork.

The two North Island men had shot an ailing Hereford cross cow last year to slaughter it and told authorities they thought it already was dead when they speared it with the tractor. But a policeman later noticed that the animal was still alive, and it was able to stagger away when released from the tractor fork.

Farm owner Ronald Frew and farm manager Geoffrey Donald, both 43, were found guilty in Taihape District Court of ill-treating a cow.

Judge Gerard Lynch said the two men had failed to take all reasonable steps to ensure the animal was dead before it was impaled, and imposed fines of $750 for each man. The pair were cleared of the more serious charge of willfully ill-treating the cow.

Frew told the court that he asked Donald to slaughter the sick cow and that the farm manager had shot the animal in the side of the head.

Frew said he thought the animal was dead when he arrived later with the tractor and impaled it below its spine before driving about 100m toward a highway with the animal hanging on the fork.

Frew told the court he did not realise the cow was still alive until the police officer told him its head was upright.

He said he was horrified when he removed the cow from the fork and that the distressed animal staggered away to join a herd of cattle nearby. The farmer eventually killed the badly injured animal.

I don't believe for one moment that farmers, of all people, couldn't recognize whether an animal was dead or not. You should be bloody sure before you do something like impale the animal. What a horrific nightmare for the cow. Bastards.

This is so cruel, I am lost for words. But I'd just so love to impale the LIVE FARMERS with the tractor!! NN you are right, the justice system just stinks - if it wasn't for the policeman then this would have just slipped under the radar!

farmers are some of the country's cruelest people to animals i have seen it with my own eyes.beating a calf with a rubber hose until its ear was split and its nose howling all the time.running his sheep around a padack to tire them out with a trail bike until some of them colapsed with exhaustion.a nice little dog being trained to heard cows tried to please its owner made mistake so was tied up and shot.a lot of farmers are sick.

Pull your head in NN! Its an easy enough mistake to make. Often animals (humans even) get shot and look like they are dead. Then they get up and move around some time later. Plenty of documented cases in both human and animals.

When will the judiciary realise the abhorrence in which such actions are held? Consistently we see token punishments meted out to people who, though either carelessness or stupidity, have caused unnecessary suffering to animals who are quite unable to defend themselves. Confiscation of the farm might have a more deterrent effect?
