Lawyers for Britain's royal family will make a criminal complaint against the photographer who took pictures of Prince William's wife Kate sunbathing topless in the south of France.

William's office says the couple's lawyers will file the complaint with French prosecutors on Monday against the unknown photographer or photographers.

The palace says it will be up to prosecutors to decide whether to investigate and pursue the complaint.

Last week France's Closer magazine published paparazzi snaps of Kate, the Duchess of Cambridge, sunbathing topless during a holiday in Provence.

The couple's lawyers are suing Closer's publisher Mondadori in a bid to prevent further publication of the pictures.

Mondadori also owns Italy's Chi magazine, which says it will publish 26 pages of the images on Monday.

The royals need to keep their clothes on in public. Its like they want to be seen naked. Even Charlie got caught out a few years back parading around an apartment starkers with the curtains wide open.

If they sunbathe topless, they just have to expect the probability of beign photographed! If it was a public beach then they should have expected this!

The royals have been flashing their wiggly bits, doing naughty's and loving thy neighbor too much for decades. The French have always been stupid so there is a double dose of stupidly with the "oh my god" over what CATHY describes as "couple of perky boobs". Being a manchild any set is a good one but taking a photo or perving is illegal and just plain stupid.

The problem revolves around the fact that breach of privacy is an offence in France, but this fact is conveniently overlooked by the publication Closer, because there is money to be made from an 'exclusive.' Is a topless Duchess any different to any other topless woman? A world-wide boycott of any such publication using these photos would financially put the 'gutter-press' in its place.

Really, the photos are no big deal, what's so fascinating about seeing a couple of perky little boobs no matter who they belong to? The bigger the fuss and the more the palace complains the more the saga will drag on. Should have just been treated as a "So what!" issue and it would have gone away as quickly as it started.
