"Accidental millionaire" Leo Gao will stay in custody while officials consider whether he should receive electronic bail.

Gao, 30, spent Christmas in jail facing 16 charges of theft and 11 of money laundering after being extradited from Hong Kong.

The charges were laid after Gao and his girlfriend Kara Hurring fled New Zealand in 2009 following an embarrassing Westpac glitch that saw $10 million appear in Gao's overdrawn account.

The former Rotorua petrol station owner had asked for a $100,000 overdraft to prop up his ailing business.

Authorities were able to recover just over $3 million, with about $6.78 million still outstanding.

At a hearing in Rotorua District Court on Thursday, Gao's lawyer Ron Mansfield told the court he was not in a position to proceed with a bail application.

Gao was remanded in custody until January 23, when he will apply for electronic bail.

Judge Jocelyn Munro told Gao the remand would give assessors time to consider whether the address that had been nominated for him to live at was suitable.

Gao had attempted to seek bail on December 23, but no judge was available to hear the case on the last working day before Christmas.

Gao was arrested at the Hong Kong border in September and appeared in court in late October.

He agreed in November to be extradited to New Zealand and appeared in Manukau District Court late last month.

Hurring, 32, re-entered New Zealand earlier this year and was arrested on related charges. She is due to stand trial in February.
