While the 90 day trial does offer protection for the employer in terms of not being stuck with under-performing staff, it opens up opportunities for abuse and discrimination. As an employer I could turn around and dismiss an employee after 90 days because it was something personal, despite their efforts. I wouldnt have to give an explanation as the employee's right to a PG is removed. I could even repeat this process, hiring people every 90 days to avoid annual leave and sick leave payouts etc. Totally contradicts the discrimination sections in both the HRA and ERA.

But what Im really concerned about is the possibility that vulnerable workers will be exploited. For example, single mothers, who will have to search for paid work soon when their youngest is 6 years old otherwise their benefit is halved. Ok fair enough, but not when NZs unemployment levels are shocking and they may face the prospect of being sacked after 90 days.

What about new graduates as well? No job will be secure for new workers in the not-too-distant future. Our young and bright will continue to leave further contributing to the brain drain.

There are "heartless" employers out there as much as there are "unsuitable" employees. Therefore, a 90 day probationary period is acceptable but it should include a provision for "dismissal for unfair and unjust reason" in line with the principles of natural justice !!!

Bobby2010, Yes that's right, she was fired after 2 weeks & I heard her being interviewed on radio live the other day, she also took took a twenty thousand dollar pay drop from her previous job to take on the job with Dunbar Sloane, & thought this would be her new dream job but she also said that something just did not feel right from the time of her job interview & apparently had something to do with a former staff member wanting their job back after being away on leave....so the workers & unions will have to fight back to the bitter end & wait until national is dead & gone.
